The Supreme Court order in favour of NSS in the aided school appointment is applicable to other schools as well, the High Court has said. The government's previous stand was that only if three percent of the seats in aided schools are reserved for differently-abled people, the unrecognized teachers in aided schools would be made permanent. Due to this, the appointment of aided teachers was uncertain for the last five years. The NSS management approached the Supreme Court, pointing out that this was affecting the functioning of the schools.
Accepting this, the Supreme Court issued an order that if the teaching post is set aside for differently-abled people, other teaching posts in that school can be regularized. The government had issued an order in accordance with the Supreme Court's judgment to approve the appointments made in schools under NSS management, except for the differently-abled reservation posts. However, although there was a demand to issue a general order applicable to other managements in similar situations, the order was issued only for appointments in NSS schools.
It was in this situation that P. Jabira, a teacher at Kuttambur Higher Secondary School, Kozhikode, approached the High Court through advocate Ebin Mathew, seeking approval for her law. Justice N. Nagaresh observed that the order issued granting permission to NSS in this regard was also due to the petitioner. Therefore, the High Court directed the Thamarassery DEO to examine the issue of granting legal approval as per the law within two months, if necessary, after hearing the petitioner and the school manager. The petition was disposed of.
